Welcome to Eternal Memoirs (“we”, “us”, “our”). By accessing or using our website, purchasing tokens or packages, or creating a memorial page, you agree to these Terms & Conditions. Please read them carefully.

If you do not agree with these Terms, you may not use the Eternal Memoirs platform.

1. About Eternal Memoirs

Eternal Memoirs is a digital memorial platform that allows users to create, manage, and share online memorials for couples and deceased loved ones. Users may upload photos, videos, stories, and biographical information and choose whether the memorial is public or private.

Our platform is hosted and powered by Wix.com.

2. Eligibility

To use our services, you must:

  • Be at least 18 years old, OR

  • Have consent from a legal guardian

By using our platform, you confirm that all information provided is accurate.

3. User Accounts

To create a memorial, you must create an account using:

  • Email and password, OR

  • Google login via secure OAuth

You are responsible for:

  • Maintaining the confidentiality of your login details

  • All activity performed under your account

Eternal Memoirs is not responsible for unauthorised account access caused by weak passwords or sharing login credentials.

4. Memorial Content

Users may upload:

  • Photos

  • Videos

  • Biographical information

  • Dates of birth or death 

  • Stories and tributes

You agree that:

  • You own the rights to the content you upload, OR you have permission to use it

  • Your content does not violate copyright

  • Your content is respectful and appropriate

We reserve the right to remove content that:

  • Is offensive or abusive

  • Violates copyright

  • Violates any law

  • Is flagged by users or appears fraudulent

5. Public vs. Private Memorials
5.1 Public Memorials

If you set a memorial to "Public":

  • It may appear on the Eternal Memoirs public memorial listings

  • Anyone with the link or QR code can view it

  • It may appear in search results on our platform

You accept responsibility for any personal information you choose to display about the deceased.

5.2 Private Memorials

If a memorial is "Private":

  • Only you (and those you share the link/password with) can view it

  • It will NOT appear in public listings or search results

You can change these settings at any time.

6. Tokens, Packages, and Payments
6.1 Tokens

Eternal Memoirs uses a token system:

  • Each memorial creation deducts 1 token

  • Tokens are non-refundable once used

  • Tokens cannot be transferred between accounts

6.2 Subscription Packages

Packages may include:

  • Multiple tokens

  • Additional features

  • Optional add-ons

All payments are processed securely through third-party providers such as Wix Payments, Stripe, or PayPal.

Eternal Memoirs does not store credit card details.

6.3 Refund Policy

Because Eternal Memoirs delivers instant-access digital services, all purchases are non-refundable unless required by South African law.

7. Intellectual Property

All website design, branding, images, and features belong to Eternal Memoirs.

Users retain ownership of uploaded content but grant Eternal Memoirs a non-exclusive license to:

  • Display

  • Store

  • Process

their memorial content solely for the purpose of running the platform.

8. Prohibited Activities

Users may NOT:

  • Upload harmful, offensive, or defamatory content

  • Use the platform to harass others

  • Attempt to bypass token deductions

  • Manipulate or alter the website code

  • Share access to paid content

  • Upload content in violation of copyright laws

9. Limitation of Liability

Eternal Memoirs is not responsible for:

  • Loss of content caused by user error

  • Incorrect information added by users

  • Damages resulting from public memorial visibility

  • Third-party breaches caused by factors outside our control

  • Loss of account access due to forgotten passwords or lost emails

  • Incorrect use of QR codes

The service is provided “as is” without guarantees.

10. Data Protection & POPIA

We comply with the Protection of Personal Information Act (POPIA).
We collect minimal personal information, such as:

  • Email address

  • Login details

  • Uploaded memorial content

  • Token purchases

We do not collect ID numbers, physical addresses, or unnecessary sensitive information.

11. Account Termination

We reserve the right to suspend or delete accounts that:

  • Violate these Terms

  • Abuse tokens

  • Upload harmful or illegal content

  • Engage in fraud

You may also request account deletion at any time—this removes:

  • Your account

  • Your memorials

  • Your uploaded content

12. Changes to These Terms

We may update these Terms periodically.
You will be informed of major changes through:

  • Website notifications

  • Email alerts
